Terms of Service

These Terms of Service apply to Portfork, a product brand of 11075586 CANADA INC., a corporation incorporated under the Canada Business Corporations Act with headquarters in Ontario, Canada, operating under the registered Canadian trademark APLEXICA. In these Terms, “we,” “us,” and “our” refer to 11075586 CANADA INC. and its operations under the Portfork brand.
1. Acceptance
By using portfork.com, Open Source Portfork, or any service operated
by us, you accept these Terms. If you do not accept them, do not use the
service.
2. Open Source Portfork
The Portfork daemon and CLI are licensed under the GNU Affero General Public License v3.0 (“AGPL-3.0”). Your use of the open-source software is governed by that license, not by these Terms. Open Source Portfork is provided AS-IS without warranty of any kind.
3. Portfork Cloud
If you create an account on Portfork Cloud, the following additional terms apply.
3.1 Account
You must be at least 16 years old to create an account. You are responsible for keeping your credentials confidential and for activity under your account, including the apps you deploy.
3.2 Plans and billing
Paid plans are billed monthly or annually in advance for the node tier you select. Add-ons (extra storage, always-warm apps, dedicated microVMs, extra egress) are billed alongside your subscription. Fees are non-refundable unless required by law. You can cancel at any time; service continues through the end of the paid period.
3.3 Your apps and content
You are responsible for the apps you deploy and the data they process. You must have the rights to deploy and run that code and data, and your apps must comply with the Acceptable Use Policy.
3.4 Acceptable use
Don’t use Portfork to do things that are illegal, harmful, or disruptive, and don’t use it to abuse the shared infrastructure that hosts other customers’ apps. The Acceptable Use Policy sets out the details and is incorporated into these Terms by reference.
3.5 Service availability
We aim for high availability, but Open Source Portfork comes with no guaranteed uptime, and paid Cloud tiers are provided on a commercially reasonable best-effort basis unless a separate written service-level commitment applies.
4. Intellectual property
You retain all rights to the apps and content you deploy on Portfork. We retain all rights to the Portfork software, brand, and documentation other than what the AGPL grants you for the open-source daemon and CLI.
5. Privacy
How we handle your personal information is described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
6. Disclaimer of warranties
To the maximum extent permitted by law, Portfork is provided “AS IS” without warranties of any kind, express or implied.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits. Our total liability for any claim is capped at the amount you paid us in the twelve months preceding the event giving rise to the claim, or US$100, whichever is greater.
8. Termination
You can stop using Portfork at any time. We can suspend or terminate your account if you violate these Terms or the Acceptable Use Policy, or for prolonged inactivity. We will give reasonable notice except for safety, legal, or abuse reasons.
9. Changes
We may update these Terms; the effective date above reflects the most recent change. Material changes are announced on the Portfork website 30 days in advance.
10. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the courts of the Province of Ontario sitting in the City of Toronto.
